1. Agreement to Terms

By accessing or using the services provided by Molotov Production cc trading as Wirk ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Wirk provides the following services:

  • Job recruitment platform connecting employers and job seekers
  • AI-powered job assessments and skill evaluations
  • Interview question generation and practical skill tests
  • Voice-enabled interview services using AI technology
  • Resume analysis and bulk processing services
  • Subscription-based billing and credit management
  • Multi-language platform support
  • Company dashboard and applicant management tools
  • Job matching and recommendation services

3. User Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information in your profile, job postings, and applications
  • Use our services only for lawful employment-related purposes
  • Respect intellectual property rights and confidential information
  • Not interfere with the operation of our platform or other users' experience
  • Maintain the confidentiality of your login credentials
  • Not post discriminatory, offensive, or inappropriate content
  • Comply with all applicable employment laws and regulations
  • Use AI-powered features responsibly and ethically

4. Service Availability

We strive to maintain continuous service availability but do not guarantee that our services will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice. AI-powered features depend on third-party services and may have varying availability.

5. Payment and Billing

Subscription fees and payment terms are specified in your chosen plan. All fees are processed through Paystack and are non-refundable unless otherwise stated in writing. We reserve the right to suspend services for non-payment. Credit allocations and usage limits apply based on your subscription plan.

6. Intellectual Property

All platform content, AI-generated assessments, and proprietary technology remain our intellectual property. Users retain ownership of their submitted content (resumes, job postings, responses) but grant us a license to process and analyze this content to provide our services. AI-generated content is provided as-is for your use in the recruitment process.

7. Confidentiality and Data Protection

We respect the confidentiality of user information, job postings, and candidate data. We will not disclose confidential information without consent, except as required by law or as necessary to provide the requested services. All data processing complies with our Privacy Policy and applicable data protection regulations.

8. AI Services and Voice Recordings

Our platform uses AI services including Google Gemini, OpenAI, and ElevenLabs for assessments and voice interviews. By using these features, you consent to your data being processed by these services in accordance with their terms and our Privacy Policy. Voice recordings are used solely for interview purposes and candidate evaluation.

9. Limitation of Liability

To the maximum extent permitted by law, Wirk shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for your subscription in the preceding 12 months. We do not guarantee the accuracy of AI-generated content or assessments.

10. User Content and Conduct

Users are solely responsible for the content they post, including job descriptions, resumes, and responses. You warrant that your content does not violate any laws or third-party rights. We reserve the right to remove content that violates these Terms or is inappropriate for a professional recruitment platform.

11. Termination

Either party may terminate services according to the subscription terms. We reserve the right to terminate accounts immediately for breach of these Terms, non-payment, or inappropriate conduct. Upon termination, you lose access to the platform and any unused credits.

12. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be subject to the jurisdiction of the courts in our operating location.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to users via email or through our platform. Continued use of our services after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Molotov Production cc operates, without regard to conflict of law principles.
